◇ Reason for Revision
The Act on Promotion of Drone Utilization and Infrastructure Development
has been amended (Act No. 19976, promulgated on January 9, 2024, effective on
July 10; Act No. 20295, promulgated on February 13, 2024, effective on August
14) to include information on military bases and military facility protection
zones in accordance with the『Military Base and Military Facility Protection Act』 in the scope of the drone information system, and to
provide grounds for the Minister of Land, Infrastructure and Transport to
designate drone parks upon application by city/provincial governors or
mayors/county governors/district heads in order to support citizens’ hobbies
and leisure activities using drones. Accordingly, the scope and provision
method of information on military bases and military facility protection zones
included in the drone information system, as well as the designation
requirements, designation and change procedures, etc., are intended to be
established.
◇ Main Contents
A. The scope and method of provision of
information on military bases and protection zones for military facilities
included in the drone information system (Newly Inserted by Article 8-2 (1) and
(2))
The drone information system shall include the information publicly
announced pursuant to the『Protection of Military Bases and Military Installations Act』, among the information on the protection zones of
military bases and military installations, and where the relevant information
is provided, the information on military bases and military installations shall
be deleted, processed and provided in a secure manner.
B. Requirements for Designation of Drone
Parks (newly inserted Article 12-2)
The Minister of Land, Infrastructure and Transport shall designate an area
as a drone where the purpose of designation of the drone park can be achieved,
the operation plan of the drone park is appropriate and feasible, and the area
does not endanger the safety of residents and users of the drone park and the
surrounding environment.
C. Procedures for designating or
altering drone parks (newly inserted Articles 12-3 and 12-4);
1) Where a Mayor/Provincial governor, etc. intends to apply for
designation of a drone park, he/she shall submit the application for
designation of a drone park to the Minister of Land, Infrastructure and
Transport, along with a plan for operating a drone park, which includes a plan
to support the manpower and budget for the drone park, to the Minister of Land,
Infrastructure and Transport. The procedure for collecting opinions of
residents, etc. in the vicinity shall be followed.
2) When the Minister of Land, Infrastructure and Transport designates or
changes a drone park, he/she shall post the name, location, area, altitude, and
other information regarding exemption or simplified pilot certification for
those who wish to fly drones in the drone park on the website of the Ministry
of Land, Infrastructure and Transport.
3) The Aerospace Promotion Fund shall be established in order to secure
financial resources necessary to promote the development of aerospace
technology and efficiently support the promotion of the aerospace industry.
